Service-Specific Policies

This policy governs the terms and conditions of services offered by North Georgia Web LLC, operating under the trade names (“North Florida Web, North Georgia Web, SiteEngine.io” “we,” “us,” or “our”), including but not limited to website design, Google Ads management, WordPress migrations, and other professional services. By utilizing any of these services, you agree to be bound by this policy and any supplemental terms incorporated by reference.

Website Design Terms of Service

1. Definitions

  • Developer: Refers to North Georgia Web (North Florida Web LLC).
  • Client: The individual or entity engaging Developer’s services.
  • Services: Includes but is not limited to graphical design, HTML, CSS, JavaScript, MySQL programming, and related web development activities.

2. Acceptance of Work

Quotations are valid for 15 business days from issuance. A valid contract exists upon Developer’s issuance of an invoice following the Client’s order. Developer reserves the right to withdraw from the contract at any time prior to invoice issuance. Clients must verify the invoice’s accuracy and retain a copy for their records.

  • Ownership of website design, images, code, and source files transfers to the Client only upon full payment and written agreement.
  • Unless otherwise agreed, all intellectual property rights remain with Developer.
  • Clients may use the design on one domain only unless expressly agreed in writing.
  • Resale or redistribution of Developer’s work without prior written consent is prohibited.
  • Developer reserves the right to showcase completed projects in its portfolio.

4. Content and Media

Clients warrant that any content or media provided:

  • Is owned by the Client or used with proper authorization.
  • Does not infringe on third-party rights.
    Clients indemnify Developer against any claims related to supplied content.

5. Material Restrictions

Developer reserves the right to refuse:

  • Unlawful, inappropriate, or offensive content.
  • Content containing viruses or malicious code.
  • Content constituting harassment, obscenity, or spamming.

1. Service Overview

Developer provides pay-per-click (PPC) advertising management, including keyword research, ad creative development, landing page optimization, and campaign tracking.

2. Payment Terms

Monthly fees are based on ad spend tiers:

All fees are due within 10 calendar days of invoice issuance. Late payments incur a 1.5% monthly interest rate (18% annual).

3. Additional Charges

Services beyond the agreed scope are subject to additional fees at the current hourly or project rate.

4. No Guarantee

While Developer employs best practices, no specific outcomes (e.g., ROI, lead generation) are guaranteed.

WordPress Migrations Terms

1. Turnaround Time

Migrations are completed within 48 hours upon receiving all requested credentials and confirmation of access to the source site. Delays in Client responses may pause the migration and void the turnaround guarantee.

2. Limitations

  • Migrations are limited to WordPress websites.
  • Email migration is not included and must be managed separately by the Client.
  • Developer cannot guarantee full functionality if:
    • The site is hacked during the migration process.
    • Credentials provided are incomplete or inaccurate.

3. Refunds

Refunds are available only if Developer fails to meet the quoted turnaround due to internal delays. Refund eligibility is forfeited under the following conditions:

  • Lack of Client response for more than 12 hours.
  • Interference with the migration process.

General Terms

1. Client Responsibilities

Clients are responsible for:

  • Providing accurate and timely information.
  • Responding to communication promptly.
  • Ensuring website backups before engaging Developer’s services.

2. Payment and Late Fees

  • A 25% non-refundable deposit is required before project commencement.
  • Final balances must be settled prior to the handover of deliverables.
  • Invoices are due within 7 days. Late payments are subject to a 10% late fee and 1.5% monthly interest.

3. Liability and Warranty Disclaimer

Developer is not liable for:

  • Indirect or consequential damages (e.g., lost profits, data loss).
  • Issues arising from third-party software, hosting, or domain changes.
  • Security breaches if the Client declines to renew a security update contract.

4. Termination

Developer may terminate services without notice if the Client breaches this agreement.

Professional Services and Renewals

1. Recurring Services

Recurring services automatically renew unless canceled 7 calendar days prior to renewal.

2. Modifications

Projects exceeding six months may be subject to revised terms or additional charges.

Indemnification

Clients agree to indemnify Developer against any claims, liabilities, or damages arising from:

  • Content provided by the Client.
  • Failure to comply with applicable laws.

Governing Law

This agreement is governed by the laws of the State of Georgia, USA. Any disputes must be resolved in Georgia state or federal courts.
