Domain and Hosting Policy

This Domain and Hosting Policy governs the terms of domain registration, hosting, and associated services provided by North Georgia Web LLC, operating under the trade names (“North Florida Web, North Georgia Web, SiteEngine” “we,” “us,” or “our”)(hereinafter referred to as “the Company”) By purchasing or using our services, you agree to comply with this policy in its entirety.


1. General Terms

1.1 Scope:
This policy applies to all domain registrations, transfers, hosting services, and related activities facilitated by the Company.

1.2 Legal Compliance:
You agree to adhere to all applicable laws, regulations, and ICANN policies. This includes providing accurate information during registration and ensuring compliance with trademark and intellectual property laws.

1.3 Proprietary Rights:
Domain names are not property, and their registration does not confer proprietary rights. Registrations are governed by applicable ICANN and registry policies.


2. Domain Registration

2.1 Eligibility:
You represent and warrant that:

  • The domain name does not infringe upon third-party rights.
  • The domain name will not be used for illegal activities, including but not limited to phishing, malware, or fraudulent schemes.

2.2 Accuracy of Information:
You agree to maintain accurate WHOIS and account information. Failure to update your details may result in suspension or cancellation of your domain.

2.3 Verification:
Per ICANN’s 2013 RAA requirements, unverified domain registrations or WHOIS updates may lead to suspension if verification is not completed within 15 days of notice.

2.4 Fees and Renewals:

  • Domain registration fees vary by TLD.
  • Auto-renewal is the default setting for all domain registrations unless manually disabled via your account.
  • Domains that are not renewed will enter a 30-day grace period, after which they may be subject to redemption fees or deletion.

2.5 Transfers:

  • Domains are locked for transfer for 60 days following registration, transfer, or WHOIS updates unless explicitly opted out.
  • All transfers must comply with ICANN’s Transfer Policy.

3. Dispute Resolution

3.1 UDRP Compliance:
All disputes involving domain ownership or use are subject to ICANN’s Uniform Domain Name Dispute Resolution Policy (UDRP).

3.2 Mandatory Proceedings:
Disputes may require submission to an ICANN-accredited dispute resolution provider. The complainant must demonstrate:

  • The domain is identical or confusingly similar to their trademark.
  • You have no legitimate interest in the domain.
  • The domain was registered and used in bad faith.

3.3 Legal Jurisdiction:
Disputes unresolved via UDRP may proceed to courts in Fort Walton Beach, FL, under the jurisdiction of Okaloosa County courts.


4. Hosting Services

4.1 Hosting Terms:

  • Hosting services include data storage, email accounts, and website hosting features as outlined in your selected plan.
  • Overuse of allocated resources may incur additional fees or suspension.

4.2 Uptime and Maintenance:
While we strive for 99.9% uptime, occasional maintenance or unforeseen outages may occur.

4.3 Content Restrictions:
Hosting services may not be used to distribute illegal, obscene, or infringing content. Violations will result in immediate termination.


5. Privacy and Proxy Services

5.1 WHOIS Privacy:
The Company offers WHOIS privacy protection via a third-party service. By enabling privacy protection, you authorize us to act as the registrant proxy.

5.2 Disclosure of Information:
We reserve the right to disclose proxy-protected information to comply with legal requirements, ICANN policies, or dispute resolution processes.


6. Modifications and Termination

6.1 Policy Amendments:
The Company reserves the right to modify this policy at any time. Changes will be posted at [Insert URL] at least 30 days before taking effect.

6.2 Termination:
We may terminate domain or hosting services for violations of this policy, non-payment, or as required by law.


7. Limitation of Liability

The Company shall not be held liable for:

  • Loss of domain or hosting services due to failure to renew.
  • Service interruptions or data loss resulting from force majeure, unauthorized access, or customer actions.

Maximum liability is limited to fees paid for the disputed service during the prior 12 months.


8. Indemnification

You agree to indemnify and hold the Company, its affiliates, and employees harmless from any claims arising from your use of our domain and hosting services.


9. Governing Law

This policy is governed by the laws of the State of Florida. Any disputes must be filed in Okaloosa County, FL.
