These General Terms of Service (“Terms”) constitute a binding legal agreement between North Georgia Web LLC, operating under the trade names (“North Florida Web, North Georgia Web, SiteEngine” “we,” “us,” or “our”), and any person or entity (“Customer,” “you,” or “your”) who purchases, accesses, or uses our services. By using our services, you agree to these Terms, any policies referenced herein, and any additional terms applicable to specific services (collectively, the “Agreement”).

If you do not agree to these Terms, you must not access or use any of our services.

1. Services

North Georgia Web provides various services, including but not limited to:

  • Web hosting (shared, VPS, and dedicated hosting)
  • WordPress hosting
  • Email services
  • Cloud services
  • Web design
  • Digital marketing
  • Domain registration

These services, collectively referred to as “Services,” are subject to these Terms and any specific agreements or policies associated with each service.

2. Account Information

2.1. Accuracy of Information: You agree to provide and maintain accurate, complete, and current account information (“Account Information”). Failure to provide accurate information may result in suspension or termination of your account without refund.
2.2. Privacy and Security: You authorize us to disclose Account Information to third parties for fraud prevention and security purposes, in accordance with our Privacy Policy and Data Processing Addendum.
2.3. Account Management: You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately if you suspect unauthorized access. You are liable for all activities conducted through your account.

3. Financial Terms

3.1. Payment Obligations: You agree to pay all fees associated with your Services. Fees are non-refundable unless explicitly stated otherwise.
3.2. Automatic Renewal: Services automatically renew at the then-current rate unless canceled prior to the renewal date. You may cancel services through your account management portal.

3.3. Refund Policy:

  • Shared hosting includes a 7-day money-back guarantee.
  • Domain registrations, SSL certificates, and third-party services are non-refundable.
  • Refund requests must comply with the applicable refund policies outlined in the Agreement.

3.4. Failed Payments and Chargebacks:

  • If payment fails, we may attempt to use alternative payment methods linked to your account.
  • Chargebacks will result in a $50 fee and potential suspension of your account.

3.5. Service Modifications: We reserve the right to change service plans, fees, and charges with prior notice. You may cancel services without penalty in response to such changes, but refunds for previously paid amounts will not be issued.

4. Taxes

You are responsible for any taxes or fees associated with your purchases or the use of our Services. North Georgia Web is not liable for these obligations.

5. Service Usage

5.1. Customer Responsibilities: You are responsible for ensuring that materials and data provided to us are server-ready and compliant with our Acceptable Use Policy. You acknowledge that using our Services requires knowledge of internet protocols, software, and web publishing.
5.2. Network Integrity: We reserve the right to:

  • Monitor network activity to ensure compliance with these Terms.
  • Suspend or terminate accounts that pose a security threat or violate our policies.

5.3. Unlimited Policy: While disk space and bandwidth are advertised as unlimited for shared hosting plans, certain activities (e.g., file-sharing, distribution, and hosting copyrighted material) are prohibited and may result in account termination. Refer to the Unlimited Policy for specific restrictions.

6. Uptime Guarantee

6.1. Uptime Commitment: We guarantee 99.9% uptime for applicable Services. Scheduled maintenance and customer-side configuration errors are excluded from uptime calculations.
6.2. Compensation: Eligible downtime credits must be requested within 14 days of the incident by submitting a support ticket.

7. Termination

7.1. Termination by Customer: You may terminate your Services with 14 days’ notice by submitting a request via email or through the account management portal.
7.2. Termination by North Georgia Web: We reserve the right to terminate your account without notice for non-payment, policy violations, or activities deemed harmful to our network or customers.

8. Limited Liability

8.1. Disclaimer: We do not guarantee uninterrupted or error-free Services and are not liable for damages resulting from Service interruptions, loss of data, or unauthorized access.
8.2. Limitation of Liability: Our liability is limited to the fees paid by you in the six (6) months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless North Georgia Web, its affiliates, and employees from any claims, damages, or expenses arising from your use of our Services, including but not limited to:

  • Violations of intellectual property rights.
  • Harm caused by products or services offered through your account.

10. Intellectual Property

You warrant that you have the necessary rights to use trademarks, copyrights, and other intellectual property associated with your account. By submitting content to us, you grant us a license to use it for operational purposes.

11. Sanctioned Countries

You agree to comply with U.S. export laws and regulations. You may not use our Services to engage with prohibited entities or individuals as defined by U.S. law.

12. Feedback and Suggestions

By providing feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use such feedback for any purpose.

13. Governing Law

This Agreement is governed by the laws of the State of Florida, without regard to its conflict of laws principles. Any disputes shall be resolved exclusively in the courts of Okaloosa County, Florida.

14. Amendments

We reserve the right to update these Terms to reflect changes in our Services or policies. Continued use of our Services after updates constitutes your acceptance of the revised Terms.

15. Entire Agreement

These Terms, along with referenced policies and agreements, represent the entire agreement between you and North Georgia Web.
